Handling of Complaints and Appeals
General Provisions
The Certification Organization provides the applicant with the opportunity for legal remedy following the dispatch and receipt of the EU-type examination certificate. The Certification Organization accepts objections, complaints, and appeals related to the rejection of the certificate from the applicant within 30 days from the receipt of the decision, which must be stipulated in the contract. If the applicant does not exercise the right to legal remedy within the deadline stipulated in the contract, or if the applicant shows no intention to request a modification or a new assessment within this period, after the deadline, the Certification Organization’s director will notify the certificate holder, the designating authority, and other notified bodies carrying out the same activities about the negative outcome of the conformity assessment in accordance with the decisions of the notified bodies.
Handling Complaints
NEVEX Ltd. Certification Organization accepts complaints both in writing and verbally.
NEVEX Ltd. Certification Organization considers any dissatisfaction related to its activities or administration as a complaint. The Certification Organization is obliged to respond substantively to complaints within 15 working days. During the complaint investigation, it must be determined whether there was any omission or other event during the professional evaluation that influenced the result and objectivity of the assessment. The investigation involves the quality manager and the certifiers, but no person who participated in the EU-type examination certification of the given plant protection product may be involved. If the complaint is found to be justified, the managing director orders the necessary corrective, corrective, and preventive actions. The measures are carried out with the designation of those responsible for completing the tasks and deadlines, and the execution is monitored by the managing director. The managing director continuously informs the complainant about the status and outcome of the case. The information must cover the legitimacy of the complaint and the actions taken. We always respond to complaints in writing to the complainant. If the internal investigation reveals non-compliance in any activity, the Certification Organization must act according to section 8.7 of the Quality Management Manual regarding corrective actions. All records of complaints and their investigations are collected by the managing director in the “Complaints” file and stored in the Archive.
Handling Appeals
The applicant may appeal according to the contract following the dispatch and receipt of the EU-type examination certificate. The Certification Organization is obliged to respond substantively to the appeal within 15 working days. Suspension of EU-Type Examination Certificate
If the market surveillance or other competent authority of any member state of the European Union files a complaint against an EU-type examination certified Union plant protection product issued by NEVEX Ltd. Certification Organization, finds it non-compliant, or deems the issuance of the certificate inappropriate, the managing director may order the suspension of the certificate until the matter is investigated. The Certification Organization immediately notifies the relevant authority/authorities about the suspension of certificates for any reason. The Certification Organization immediately publishes the suspension of certificates on its website.
Revocation of EU-Type Examination Certificate
If the market surveillance or other competent authority of any member state of the European Union finds a Union plant protection product with an EU-type examination certificate issued by NEVEX Ltd. Certification Organization non-compliant, or deems the issuance of the certificate inappropriate, the managing director investigates the matter and, if the product or certificate in question is found non-compliant and no other corrective action is applicable, revokes the certificate. The certificate holder, the designating authority, and other notified bodies carrying out the same activities are informed about the revocation.
In the case of certificate revocation, a certificate revocation form must be issued within 8 working days. The decision to revoke the certificate must be sent to the applicant within 8 working days. The Certification Organization immediately notifies the relevant authority/authorities about the revocation of certificates for any reason. The Certification Organization accepts objections, complaints, and appeals related to the revocation of the certificate from the applicant within 30 days from the receipt of the decision, which must be stipulated in the contract. The Certification Organization is obliged to respond substantively to the complaint or appeal within 15 working days. The Certification Organization immediately publishes the revocation of certificates on its website.
