It allows for the recognition of authorizations granted by one member state (the &#8220;reference member state&#8221;) to be accepted by other member states (the &#8220;concerned member states&#8221;) within the same regulatory zone. <\/p>\n<p>The mutual recognition process operates as follows:<\/p>\n<p>1. Authorization in the Reference Member State: A company seeking authorization for a plant protection product submits its application to a member state within a specific regulatory zone. This member state becomes the reference member state (RMS). The RMS conducts a thorough evaluation of the application, assessing the product&#8217;s safety, efficacy, and potential risks.  <\/p>\n<p>2. Granting of Authorization: If the RMS determines that the plant protection product meets the necessary requirements, it grants authorization for the product within its territory.<\/p>\n<p>3. Notification to Concerned Member States: Once the RMS grants authorization, it notifies the concerned member states (cMS) within the same regulatory zone. The cMS are given the opportunity to review the assessment and decision made by the RMS. <\/p>\n<p>4. Evaluation by Concerned Member States: The cMS have 120 days to evaluate the authorization granted by the RMS. During this evaluation period, the cMS consider whether the conditions under which the product was authorized in the RMS are applicable and appropriate within their own territories. <\/p>\n<p>5. Mutual Recognition Decision: After the evaluation period, if the cMS do not identify any specific concerns or justifiable reasons to prohibit or restrict the use of the plant protection product, they are obligated to recognize the authorization granted by the RMS. The product can then be placed on their respective markets. <\/p>\n<p>6. Restrictions or Prohibitions: In certain cases, a concerned member state may identify legitimate reasons to restrict or prohibit the use of the authorized plant protection product within its territory. Such decisions must be justified and communicated to the RMS and the European Commission. <\/p>\n<p>The mutual recognition process allows for the efficient circulation of authorized plant protection products within the European Union, reducing duplicative evaluations and facilitating access to safe and effective products for farmers and other users.
